Marla Berger has extensive experience originating, servicing and enforcing complex commercial mortgage and mezzanine debt for securitized and balance sheet loans. She has solid construction loan know-how, and a deep real estate business background.
Marla's practice at McCoy & Orta focuses on originating highly structured conduit, bridge and mezzanine loans. Throughout her career, she has handled originations on all property types from hotels to commercial condominiums and everything in between.
Marla began her legal career at Thacher Proffitt and Wood, in New York City where she was made an equity partner in the Real Estate Group. Her career coincided with the early commercial mortgage securitization market: Marla was one of the first attorneys in the industry to close securitized loans, and she developed the initial form loan documents and guidelines used by many conduit lenders during CMBS 1.0.
In addition to 20 years of legal experience, Marla was a real estate executive at Capmark Finance, Inc. As Director of Underwriting and Closing she was responsible for $2.5 billion in annual fixed and floating rate loans. She was then appointed COO of Proprietary Lending with $5 billion in annual loans. During the recession Marla headed Client Relations and Portfolio Management, supervising 200 employees and handling Capmark’s $350 billion servicing portfolio and $12 billion in the balance sheet portfolio.
Thus, Marla has a practical perspective on commercial real estate loan originations, drawing on her years of legal and significant business experience in the industry. She is distinctively able to understand clients' business needs and find successful legal solutions.
Marla and her husband, David live in New York City with their son and daughter.
